General conditions of sale
Introduction These conditions are agreed between: Autour de l’ane – 7 le bourg – 50580 Saint-Lô-d’Ourville and: Those persons who wish to make a purchase via the internet site “autourdelane.fr”, hereinafter called “the purchaser” Purpose To establish the conditions of sale between the company and the purchaser: order of goods and services, payment and delivery They cover all the necessary stages of placing and following up an order between the contracting parties Article 1 – Prices All prices are indicated in Euros (including VAT) Autour de l’âne reserves the right to modify its prices at all times, but products will be invoiced at the price indicated when an order is placed Acceptance of price and description of goods for sale is implicit in the placing of an order Article 2 – Order The order form should be printed and completed by the purchaser and sent, with accompanying cheque, to us. No order will be sent out until full payment (including postage) has been received Autour de l’âne reserves the right to cancel or refuse an order from any client with whom it is in dispute over payment of a previous order Currently, orders can only be sent out within France Article 3 – Payment Payment may only be made by cheque and sent to Autour de l’âne – 7 le bourg – 50580 Saint-Lô-d’Ourville. All cheques must be drawn on a bank in metropolitan France. Cheques are cashed on receipt of the order, on condition that all the articles are available. If this is not the case, you will be informed of any proposed changes and will be free to cancel your order. Article 4 – Validation Before forwarding your order, you must confirm your knowledge and acceptance of these terms and conditions Unless otherwise stated, the information registered by Autour de l’âne constitutes proof of the transaction between the company and its clients. Article 5 – Availability of products Products and prices are valid all the time they are visible on the site, providing they are in stock. For those products out of stock, offers will remain valid on condition that they are available at the suppliers. You will be informed of the availability of products once you have put in an order. As this information comes directly from the suppliers, there may occasionally be errors or modifications. If, once the order is processed, a product is no longer available, you will be informed by email or by post. Your order will automatically be cancelled and the cheque will not be cashed by Autour de l’âne until such time as the article is in stock. The cheque will be banked only when the order has been sent out. Article 6 – Delivery We undertakes to deliver orders as quickly as possible once they and the accompanying payment have been received The products will be delivered to the delivery address which figures on the order form. For out of stock articles, it is impossible to indicate a delivery date, as this will depend on their availability at the suppliers. In this case, Autour de l’âne cannot be held responsible for any delivery delays. We invite you to make regular contact with us by email ( This e-mail address is being protected from spambots. Article 7 – Product conformity Autour de l’âne will reimburse or exchange any sub-standard articles as quickly as possible, on condition that they are returned within 15 days of their receipt (proof provided by postmark). The full cost of postage will be reimbursed on any article that is returned due to an error on our part. I cannot take into account any claim that is received beyond this 15-day delay. I cannot take back any articles that are returned incomplete, damaged or dirty. In all circumstances, you are covered by those statutory guarantees currently in application regarding hidden defects. You have 7 days after receipt of your order to cancel it, with no obligation to provide a reason, and with no penalty, with the exception of the cost postage on the returned articles. Legislation and competence The current conditions are applicable uniquely between physical persons who are not traders. All parties agree that they will be governed by this contract. The conditions are subject to French legislation. In case of dispute, and inability to solve it by amicable agreement, such dispute will be put before the competent legal authority. |
